Para qué usamos tus datos: (1) reunir y revisar tu set de fotos para entrenar un modelo de IA con tu imagen («gemelo digital») con el que se crea contenido según nuestro contrato; (2) onboarding (cuestionario, setcard, límites, bloqueos geográficos); (3) comunicación y seguimiento del progreso; (4) registro de eventos como prueba de lo entregado y aprobado.
Base legal: el contrato y las medidas previas al contrato (art. 6.1.b RGPD); para el entrenamiento de IA y para contenidos íntimos (fotos topless, matriz de contenido, límites) tu consentimiento expreso en el Anexo A (art. 6.1.a y art. 9.2.a RGPD) — puedes retirarlo en cualquier momento con efecto para el futuro; el registro de eventos se basa en nuestro interés legítimo de documentar la colaboración (art. 6.1.f). Si un intermediario nos facilitó tus datos, te informamos de ello (art. 14).
Quién recibe tus datos: nuestros proveedores bajo contrato de encargo: el hosting del servidor (Hetzner, Alemania/UE), el proveedor que entrena el modelo de IA con el set aprobado (solo fotos sin metadatos; si está fuera de la UE, únicamente con las cláusulas contractuales tipo de la UE), un servicio de traducción en la UE para el cuestionario (DeepL) y el servicio de firma electrónica del contrato (DocuSign). Las notificaciones internas por Discord contienen solo tu número de expediente, nunca tu nombre ni fotos. No vendemos ni cedemos tus fotos a nadie más.
Cuánto tiempo: si no llegamos a un contrato, tus fotos y datos se eliminan automáticamente a los 30 días; durante el contrato se conservan; al terminar el contrato o si retiras tu consentimiento, se eliminan las fotos y el modelo de IA en los plazos previstos en el contrato. Copias de seguridad: 7 días. Registro de eventos: 12 meses. Tras una cancelación conservamos solo un apunte mínimo (número de expediente, fecha, resultado — sin fotos) para no volver a contactarte por error; puedes oponerte a ello.
Tus derechos: acceso, rectificación, supresión, limitación, portabilidad, oposición y retirada del consentimiento (art. 15–21 RGPD) — escríbenos por Telegram o al e-mail de arriba. Puedes reclamar ante la autoridad de control: Bayerisches Landesamt für Datenschutzaufsicht (BayLDA), Promenade 18, 91522 Ansbach, Alemania.
Decisiones automáticas: las comprobaciones automáticas (resolución, metadatos, duplicados) solo dan avisos técnicos; la decisión sobre cada foto la toma siempre una persona. No se realiza identificación biométrica.
Seguridad: servidor propio en la UE, cifrado de la conexión (TLS), acceso solo con tu enlace personal y PIN, sin registro de direcciones IP.

Zwecke: (1) Erhebung und Prüfung eines Foto-Sets zum Training eines KI-Modells mit dem Abbild der Person zur vertraglich vereinbarten Content-Erstellung; (2) Onboarding (Fragebogen, Setcard, Grenzen, Geo-Blocks); (3) Kommunikation und Fortschrittsverfolgung; (4) Ereignisprotokoll als Nachweis von Lieferung und Freigabe.
Rechtsgrundlagen: Vertrag/vorvertragliche Maßnahmen (Art. 6 Abs. 1 lit. b); für KI-Training und intime Inhalte (Topless-Fotos, Content-Matrix, Grenzen) die ausdrückliche Einwilligung in Anlage A (Art. 6 Abs. 1 lit. a, Art. 9 Abs. 2 lit. a) — jederzeit mit Wirkung für die Zukunft widerruflich; Ereignisprotokoll: berechtigtes Interesse (Art. 6 Abs. 1 lit. f). Bei Vermittlung durch Dritte: Information nach Art. 14.
Empfänger (Auftragsverarbeiter): Hosting Hetzner Online GmbH (DE/EU); Trainings-Dienstleister für das KI-Modell (nur freigegebene, metadatenfreie Fotos; außerhalb der EU nur mit EU-Standardvertragsklauseln); Übersetzungsdienst DeepL (EU) für den Fragebogen; DocuSign für die Vertragsunterzeichnung. Interne Discord-Benachrichtigungen enthalten nur die Akten-ID, keine Namen oder Fotos. Keine Weitergabe oder Verkauf an sonstige Dritte.
Speicherdauer: ohne Vertragsabschluss automatische Löschung nach 30 Tagen; während des Vertrags; nach Vertragsende oder Widerruf Löschung von Fotos und KI-Modell in den vertraglichen Fristen. Backups 7 Tage. Ereignisprotokoll 12 Monate. Nach Absage bleibt ein Minimalvermerk (Akten-ID, Datum, Ausgang — ohne Fotos), um versehentliche Neuansprache zu vermeiden; Widerspruch möglich (Art. 21).
Betroffenenrechte: Art. 15–21 DSGVO sowie Widerruf der Einwilligung — per Telegram oder E-Mail. Beschwerderecht: Bayerisches Landesamt für Datenschutzaufsicht (BayLDA), Promenade 18, 91522 Ansbach.
Keine automatisierte Entscheidung (Art. 22): automatische Prüfungen liefern nur technische Hinweise, jede Foto-Entscheidung trifft ein Mensch. Keine biometrische Identifizierung.
Sicherheit: eigener EU-Server, TLS, Zugang nur über persönlichen Link + PIN, keine Speicherung von IP-Adressen.

What we use your data for: (1) collecting and reviewing your photo set to train an AI model of your likeness ("digital twin") used to create content under our contract; (2) onboarding (questionnaire, set card, limits, geo-blocks); (3) communication and progress tracking; (4) an event log as evidence of what was delivered and approved.
Legal basis: the contract and pre-contractual steps (Art. 6(1)(b) GDPR); for AI training and intimate content (topless photos, content matrix, limits) your explicit consent in Annex A (Art. 6(1)(a) and Art. 9(2)(a) GDPR) — you can withdraw it at any time with effect for the future; the event log is based on our legitimate interest in documenting the collaboration (Art. 6(1)(f)). If an intermediary provided your data to us, we inform you accordingly (Art. 14).
Who receives your data: our processors under contract: server hosting (Hetzner, Germany/EU), the provider training the AI model with the approved set (photos without metadata only; outside the EU only under the EU standard contractual clauses), an EU translation service for the questionnaire (DeepL) and the e-signature service for the contract (DocuSign). Internal Discord notifications contain only your file number, never your name or photos. We never sell or pass your photos to anyone else.
How long: if no contract is concluded, your photos and data are deleted automatically after 30 days; during the contract they are kept; after the contract ends or you withdraw consent, the photos and the AI model are deleted within the periods set in the contract. Backups: 7 days. Event log: 12 months. After a cancellation we keep only a minimal note (file number, date, outcome — no photos) to avoid contacting you again by mistake; you may object to this.
Your rights: access, rectification, erasure, restriction, portability, objection and withdrawal of consent (Art. 15–21 GDPR) — message us on Telegram or at the email above. Automated decisions: automatic checks (resolution, metadata, duplicates) only produce technical hints; every decision about a photo is made by a person. No biometric identification is performed.
